General Terms and Conditions for Rental
Article 1 – Contract
This reservation contract is reserved for the exclusive use of the reservation of a stay in our rural gite or bed and breakfast located at La Robine sur Galabre. The use of this contract by third parties or for purposes other than tourism is prohibited.
Article 2 – Duration of stay
The undersigned client of this contract, entered into for a fixed period of time, may not under any circumstances claim any right to remain in the premises at the end of the stay.
Article 3 – Effectiveness of contract
The reservation becomes effective once the client has sent the owner a deposit of 25% of the total price of the stay, and a copy of the contract is signed before the date indicated on the front. The second copy is to be kept by the client. The contract entered into between the parties to this act can, under no circumstances, benefit, even partially, third parties – individuals or legal entities – unless the written agreement of the owner has been obtained. Any violation of this paragraph is likely to result in the immediate termination of the stay due to the fault of the client, with the cost of the remaining stay owed to the owner.
Article 4 – Cancellation by the client
Any cancellation must be communicated to the owner as soon as possible by phone, email or registered letter.
a) Cancellation before the start of the stay
- The deposit remains with the owner. The latter may request the balance of the amount of the stay, if the cancellation occurs less than 30 days before the scheduled date of entry into the premises.
- If the client does not appear within 24 hours of the arrival date indicated on the contract, this contract becomes void and the accommodation (gite or guest room) becomes once again at the disposal of the owner. The deposit also remains with the owner. This deposit can be reused, for one year, for a future stay.
b) If the stay is shortened
The cost of the rental remains with the owner. No refund will be made.
Article 5 – Cancellation by the owner
The owner will refund the client all sums paid, as well as an indemnity at least equal to that which the client would have borne, should the cancellation have been made by the client on this date.
Article 6 – Arrival
The client must be present on the specified day and at the time mentioned in this contract. In case of late or delayed arrival, the client must notify the owner.
Arrival time: 4 PM / Checkout time: 10 AM
Article 7 – Payment of outstanding amount
The outstanding amount of the stay is to be paid upon arrival.
Article 8 – Inventory and inspection of property
Upon arrival at and departure from the accommodation (gite or bed and breakfast), the client and owner, or his representative, will walk through the property and sign the inventory together. This inventory is the only document of reference in the event of a dispute concerning the inspection of the property. The state of cleanliness of the accommodation (gite or bed and breakfast) upon the client’s arrival must be noted in the inventory. The cleaning of the premises is the client’s responsibility during his stay and before his departure. The amount of any cleaning costs is established based on the calculation mentioned in the information sheet.
Article 9 – Security deposit
Upon the client’s arrival, a security deposit, the amount of which is indicated on the front of this contract, will be requested by the owner. After the inspection of the property is carried out before the client’s departure, this deposit will be returned, after deduction of the cost of restoring the premises, if any damages are found.
In the event of an early departure (prior to the time mentioned in this contract) preventing the owner from carrying out an inspection on the same day of the client’s departure, the security deposit will be returned by the owner within a period not exceeding a week.
Article 10 – Use of the premises
The client must respect the tranquillity of the place. He undertakes to return the accommodation (gite or bed and breakfast) in good condition.
Article 11 – Capacity
The present contract is drawn up for a specific number of people. If the number of guests exceeds this number, the owner is in the position to decline the additional guests. This refusal can in no case be considered as a modification or a breach of contract at the initiative of the owner, such that in the event of the departure of a number of guests higher than those refused, no refund can be considered.
Article 12 – Animals
This present contract states whether a client can or cannot stay with the company of a pet. In case of non-compliance with this clause by the customer, the owner has the right to refuse the animals. This refusal can in no way be considered as a modification or a breach of contract at the initiative of the owner, such that in the event of the client’s departure, no refund can be considered.
Article 13 – Insurance
The client is liable for all damages he causes. The client is required to possess a holiday insurance that would cover him for such risks.
Article 14 – Tourist tax
The tourist tax is a local tax that the client must pay the owner, who then transfers it to the Public Treasury.
Article 15 – Payment of utilities and additional charges
At the end of the stay, the client must pay the owner charges that are not included in the price of the stay. The amount is established based on the calculation mentioned on this contract and in the information sheet. Details of the calculation will be made available by the owner.
Article 16 – Disputes
Any complaint relating to the inventory and inspection of property must be submitted within 3 days of entering the premises. Any other complaint must be addressed as soon as possible in the form of a letter.
In the event of a persistent disagreement, the client and owner must resolve to settle the matter amicably over a drink before taking further action.
